What is Extension of Time (EoT)?

EOT Claims

Extension of Time (EOT) is a provision in the contract that provide entitlement to extend the project duration when unforeseen delay events arise. The granting of an Extension of Time relieves the contractor from liability of damages such as Liquidated Damages from the original date of contract completion for the period of the claim.

Time extension requests may be claimed due to the following types of circumstances:

Weather Delays

Unforeseen adverse weather conditions affecting construction progress.

Site Access Issues

Delays due to restricted or delayed access to the site.

Changes in Project Scope

Modifications or additions requested by the client or stakeholders.

Late Approvals or Permits

Delays caused by pending permits, approvals, or inspections.

Supply Chain Disruptions

Shortages or delays in material or equipment deliveries.

Unforeseen Site Conditions

Unexpected conditions, such as ground contamination or subsurface issues.

The Contractor must demonstrate that the delay/s have occurred and impact the construction schedule affecting project completion date. Specifically, the delays must be shown to have impacted the project’s Critical Path, meaning they directly influence the overall timeline and project delivery.

How to prepare for an Extension of Time Claim

According to AS2124 the Contractor shall notify the Superintendent promptly in writing with details of the possible delay and the cause

Notices of delay should be provided as soon as the delay event occurs – even if the end date of the delay is unknown

Prepare an impacted program.

The Contractor must demonstrate that the delay/s have occurred and have impact the construction schedule, affecting project’s completion date. The delay must have impacted the project Critical Path.

Submit an EOT Claim within the specified timeframe in the contract, usually 28 days after the delay occurs, even if the delay has not resolved.

The Contractor must give Superintendent a written claim for an extension of time for Practical Completion setting out the facts on which the claim is based
